Race Discrimination Lawyer | Here to Represent You

There are few things worse than being denied opportunities because of someone else’s ignorance. Unfortunately, this kind of discrimination is more prevalent in society than any of us would like to think, and if you have experienced it in an employment setting, you need a strong legal advocate on your side. An experienced Los Angeles employment discrimination lawyer from our firm can help fight for the justice you deserve.

Your State Rights

As an employee in the state of California, you should understand that state law protects you from discrimination based on your race, national origin, “perceived race,” color, and hairstyle, among other things. According to the California Fair Employment and Housing Act, it is unlawful to discriminate against employees due to where they were born, the way they look, or their heritage.

Your Federal Rights

Federally, employees are protected from race-based discrimination in the workplace under Title VII of the Civil Rights Act of 1964. Under the Act, if an employee is discriminated against in the workplace because of their race, they can file a discrimination claim with the Equal Employment Opportunity Commission.

Were You a Victim of Workplace Discrimination?

There are various ways in which employers and co-workers can discriminate against their employees. That said, some of the most common examples of race-based discrimination in the workplace include:

  • Refusing to hire employees based on their race
  • Terminating employees due to their race
  • Neglecting to promote certain employees or demoting certain employees due to race
  • Unlawfully retaliating against employees for reporting race-based discrimination
  • Harassing employees with race-based remarks

Filing a Discrimination Claim in California

If you work for an employer with more than five employees, you can file a discrimination claim under the California Fair Employment and Housing Act with the California Department of Fair Employment and Housing. You may also file a discrimination claim with the federal Equal Employment Opportunity Commission, but you should note that filing with the DFEH is sometimes preferable, as it tends to offer broader protections to workers.

You should also note that in most cases, you will only have 180 days to file a discrimination claim with the EEOC, whereas you will typically have up to three years from the last incident of discrimination to file a claim with the DFEH. That said, you should make it a point to file your discrimination claim sooner, rather than later. The sooner you act, the sooner we can get started fighting for the compensation and justice you deserve.
